Mood Patterns is an offline self-reflection and personal data analytics tool. It is NOT a medical device and does NOT provide medical, psychological, or psychiatric advice, diagnosis, therapy, or treatment.
Emergency Situations: This application cannot be used in mental health crises. If you are experiencing thoughts of self-harm, suicide, or severe emotional distress, please contact emergency services immediately (e.g., 988 or 911 in the US & Canada, 112 in the European Union, or your local crisis helpline) or consult a licensed physician or therapist.
1. Acceptance & Scope of Service
These Terms of Service (“Terms”) constitute a legally binding agreement between you and Bernhard Piskernik (“Developer”, “we”, “us”, or “our”) regarding your use of the Mood Patterns mobile application (“App”) and the website moodpatterns.info (collectively, the “Service”).
By downloading, installing, accessing, or using Mood Patterns, you signify that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must discontinue use and uninstall the App immediately.
2. Offline Architecture & Data Responsibility
Mood Patterns is engineered around a strict local privacy model:

100% Local Storage: All surveys, notes, ratings, photos, and personalized scales reside exclusively on your physical device, protected by 256-bit AES encryption (SQLCipher).

Zero Cloud Sync: The App does not transmit, upload, or sync your personal mood records to any remote server or third-party database.

Sole Responsibility for Backups: Because we do not have access to your data or maintain cloud backups, you are solely responsible for backing up your data (using the App’s CSV and PDF export tools, or device backups). If you lose or reset your device, uninstall the App, or forget your encryption password/PIN, your data cannot be recovered by the Developer.

3. In-App Purchases, Subscriptions & Billing
Core tracking and ecological momentary assessment features in Mood Patterns are free. Additional deep analytics, custom scales, and advanced features can be unlocked via Pro upgrades:
Monthly Subscription
Auto-renews each month unless canceled at least 24 hours prior to the renewal date. Managed entirely through Google Play.
Lifetime Unlock
A single, non-recurring purchase granting permanent Pro access tied to your Google Play account.
- Payment Processing: All transactions are billed through Google Play Billing and are subject to Google Play’s terms.
- How to Cancel: You can manage or cancel your subscription at any time via Google Play > Account > Payments & Subscriptions > Subscriptions. Cancellation takes effect at the end of the current billing cycle.
- Refunds: In-app purchases and subscriptions are handled under the Google Play Refund Policy. The Developer cannot issue direct refunds.
4. Eligibility & Permitted Use
You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to use Mood Patterns.
You agree to use the Service solely for lawful, personal, non-commercial self-tracking purposes. You agree not to reverse engineer, decompile, disassemble, or tamper with the software binaries, security locks, or encryption mechanisms of the App, except where permitted by applicable law.
5. Device Permissions & Health Connect
Mood Patterns may request optional device permissions (e.g., GPS location for location-tagged surveys, camera for photo attachments, or Android Health Connect for local sleep metrics). All data fetched via these integrations is processed solely on your device, is never uploaded to any remote server, and remains subject to your revocable system permission settings.
6. Warranties & Limitation of Liability
“As-Is” Provision: The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, statutory, or implied. We do not warrant that the App will be error-free or that statistical correlation calculations represent causal medical relationships.
Limitation of Liability: To the maximum extent permitted by applicable law, Bernhard Piskernik shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of, or inability to use, the Service, including data loss, hardware malfunctions, or personal reliance on the App’s analytics.
7. Governing Law & Contact Information
These Terms are governed by and construed in accordance with the laws of Austria, without regard to its conflict of law principles.
